BOOKING TERMS & CONDITIONS INCLUDING CANCELATION POLICY

Please read the following terms and conditions carefully before booking the Acatenango Overnight Tour with us. These terms constitute a legally binding agreement between you and Balam Tour Acatenango, referred to as "we", "us", or "our". By completing and submitting the booking form, you accept the terms and conditions set out here, which form the contract between Balam Tour Acatenango and you. Any changes to these terms are only valid if written and signed by a person authorized by Balam Tour Acatenango. In these terms, we refer to tour guides, their employees, drivers, and other third parties and land administration authorities in the respective country of the tour.

1. BOOKING, RESERVATION, AND PAYMENT

To reserve the Overnight Tour, you need to fill out the online booking form and complete the payment process with PayPal. Once we receive your booking, we’ll send you a invoice and booking confirmation along with important information about the tour. Alternatively, you can email us your booking through the contact or chat form on the website.
Disclaimer: We will ask you to sign a participant agreement and liability release before the tour.

2. PERSONAL INFORMATION, PICURES, OR VIDEO CONTENT
​
To complete a booking or reservation, we will need to obtain personal information from each client. The information may be shared with our service providers to enable the provision of our services but will not be used for any other purpose without your express consent. We may use images or video content taken of you during the tour, without recourse to you and compensation, for advertising and promotional purposes through our chosen medium. In case of disagreement, you must inform us or one of our tour guides before the tour.

3. INSURANCE
​
Sufficient and valid travel insurance is mandatory for all participants who take part in the overnight tours. The travel insurance must cover medical expenses for accident, injury, illness, and death, including all expenses related to pre-existing medical conditions, emergency repatriation, and personal liability.
By completing and submitting the booking form, you confirm that you have valid proof of insurance. We reserve the right to cancel your participation in the tour at any time without the right to a refund if you are unable to provide proof of insurance upon request.

4. PHYSICAL CONDITION REQUIREMENTS
​
Participants must be in good health and physical condition to do the overnight tour. It is your responsibility to ensure you are fit for an active volcano hiking activity. We advise you not to participate if currently or are seriously ill. Participants must cover the costs of medical treatment and evacuation themselves.
Disclosure: Participants are responsible for informing Balam Tour Acatenango of any existing medical conditions and/or disabilities that pose a high risk and are likely to require medical attention during the tour. By completing the tour booking, you represent and warrant that they are in good health, mental and physical health at the time of booking, and that they will independently notify us if the condition changes. We reserve the right, at its sole discretion, to cancel your booking and participation before the start of the tour without any right to a refund.

5. CHILDREN
​
Participants under the age of 16 must be accompanied by a legal guardian. If you have any questions regarding age and eligibility, please contact us for more information.

6. MISCONDUCT BY A PARTICIPANT
​
We reserve the right to exclude participants from the tour for special reasons. This condition includes all employees and tour guides, or third-party suppliers (drivers) involved in the tour. Participants are expected to follow the guides' instructions, respect the other participants, and follow safety guidelines. If, during or before a tour, the tour guide believes that something illegal is being done, that a participant's behavior constitutes a danger or nuisance to others, or that a participant is physically unable to do the tour, he or she may be excluded from the tour. In this case, the excluded participant is not entitled to a refund.

7. TOUR ALTERATIONS
​
We reserve the right to modify, alter, or cancel a tour itinerary due to weather conditions, safety concerns, or any unforeseen circumstances. We will provide reasonable alternatives or refunds in such cases. Such change does not give you any right to cancel the tour or claim for any expense, loss, or damage you may have incurred.

8. EQUIPTMENT AND GEAR RENTALS
​
Participants are responsible for bringing appropriate clothing, footwear, and personal items as recommended by us before the tour. If equipment is provided by us, it must be returned in good condition.

9. FOOD
​
When you complete the online booking process, you can choose between regular (Carnivore), vegan, gluten-free, or dairy-free meals. We are not responsible if you are not providing any dietary or allergy information during the booking process.

10. CANCELLATION AND REFUND
Changes and cancellations by you
​
For a full refund, your changes or cancellations must be 24 hours before the pick-up on the day of the booked tour.
Cancellation in case of evacuation or personal withdrawal from the tour
​
In the unlikely event of evacuation or cancellation of a tour, we reserve the right to pass on the costs incurred for transport and communication. Participants who need to withdraw from the tour for medical or personal reasons must pay their transport or medical costs. we accept no liability for these costs.
Cancelation by Balam Tour Acatenango
​
We reserve the right to cancel a departure at any time due to "force majeure". The definition of "force majeure" refers to circumstances beyond our control such as labor disputes, disease, pandemics, industrial disasters extreme weather warnings, and volcanic activity. In the event of any cancellation, we will try to offer an alternative tour date or refund the payment. We assume no liability for any additional costs that may arise.
Cancelation due to small tour numbers

For a tour, we need at least 4 participants. If the number of participants is less than 6, we reserve the right to cancel the tour and refer you to another existing tour. In this case, we will try to offer another date, or you will receive a full refund. You are not entitled to claim any additional compensation that may result from such cancellation.

11. RISK ASSUMPTIONS
​
You understand and accept that the Acatenango Overnight Tour may involve risks. A volcano climb is a demanding trek and can present a higher level of risk of injury. Among the additional hazards and risks, high altitude, extreme weather including sudden and unexpected changes, and evacuation difficulties in the event of an injury may also pose additional risks. Participants must ensure they are in good health and able to complete this tour. We are not liable for any injuries, accidents, damages, losses, or claims arising during the tour.

12. RELEASE AND WAIVER OF LIABILITY
​
Participants agree to indemnify and hold harmless our company its employees, tour guides, and affiliated companies from any liability, claim, or damage arising out of participation in the tour.

13. SEVERABILITY
​
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. AGREEMENT
​
By booking a tour with us you confirm that you have read, understood, and agreed to these terms and conditions.
